Oh, try to find another job before quitting. You will not get unemployment -and I live in OR and have been trying to find a job since Jan. Can you talk to a supervisor to get some temp help in??
We go off location, sometimes its an hour drive away from the office... sometimes it can be 4 hours away. & we're hired as temporary seasonal workers.
I'm not familiar with the labor laws, but I thought all workers were entitled to a 30 min. break if the work day was six hours or more? How can you be exempt?
That's awful! Hope you can find another job before leaving this one!!

I do get paid for all the time I'm there, so I guess I have a "paid lunch" but I don't get time to eat or time to do anything. I have other employees with me, but none of us can leave... the lead person said I could take a 5-10 min break & run to the minute market down the block & eat while I'm working... well, I can't eat & work cause I have to talk to everyone & I touch papers random people give me so I'd want to use hand sanitizer.
looks like i have to work eleven hours straight. yes, eleven. plus two hours driving both ways. so technically fifteen hours. wont get a break either. i went to the office at four am, and wont be back there til seven pm or later. when i get there i will be there at leastt half hour to an hour.
not supposed to touch my phone but sneakin it to try to keep sane this loooong day
take pictures or run a computer or pass out papers to clients... but im an employee not independant contractor
I don't see how that constitutes because under the "nature or circumstances of the work"? But perhaps I'm not really getting what you're doing? I guess what I dont get is why you aren't able to take a break? If it's just because no one else does or your boss prefers you not to...that's not really relevant legally speaking.
i also drive to the different clients offices around the state. they randomly have me go out of town with three to five days notice and no ending schedule, just a start time
the boss isnt here but they say we cant leave.
its cuz we go out of town with thousands of dollars worth of equipment and they set us up in places but only sent two or three people. it takes ttwo people to run the equipment thou. so if one leaves the other cant work.. well, i could cuz i know how to run both machines.
Are you salary or an hourly worker? Are you getting paid for 11 hours or 8 hours?
I know how you feel. The laws for breaks don't apply to small businesses under 50 employees in CT, so there are days I don't get a break either and it sucks not to be able to do anything about it.
i get paid hourly. i get paid for the eleven hours im here plus minimun wage for driving.
the labour break laws apply to small businesses but when thyre off location idk. i went to our human resources department but they cant help. i have to call a number.. but from eight am to four pm and i work all those times without a break to call.
I'm going out on a limb here, but you could inquire about the legality of your hours/lack of breaks, overtime rights, etc. with the OR Employment Department.
While I have no advice other that to try and find a job in the few hrs you have off, I can sympathize. My first job out of school was as a "Marketing Director" which wound up actually being a mgr of an unkilled home care nursing staff. Have you ever seen The Devil Wears Prada? THAT was my job! Except in Health Care. I would be at the office 9-11 hrs a day and then get calls at 2:30 am from employees saying they couldn't work because a family member had just shot someone... Then, I'd have to call and piss others off at 2:30 to replace them so the patient would have care at 7am.
I lost 30 lbs, stopped having a period, and literally... almost had a heart attack. If it get's to that point, LEAVE. Don't worry about the money, just leave. If you can handle it a while longer, find a job. I was lucky in that I found a new job before I turned in my notice to quit as all the S*** with my health was hitting the fan... I don't know how I lasted 6 months....
wow klp crazy... you did that for six months. ive only been here for one month and know i wont last much longer.
the regional manager stopped by today at the location im at. i asked her about getting a break and she did not seem to care. she said follow the schedule but we dont have a schedule, she means the locations staffs scedule and during that lunch, their ma agers come in. so no break.

I'm probably in the minority here, but I would just say to quit now. I know so many people who have worked in horrible, horrible situations, and have stayed much longer than they should have. And once they quit, they always say, "I should have done that sooner." I mean, yeah, it would be nice to find another job for a smooth transition. However, sometimes your mental health is more important.
You could always do office temp work until you find something permanent.
Thank you, I am STRONGLY considering quitting. Next week, I only work one day & it should hopefully just take 6 hours. I don't mind working 6 hours straight with no lunch (its legal that way)... mostly its that I often work overtime or even double the 6 hours & get no break at all. I'll tough it out next week, its just this week I worked 4 long days without any breaks.
Also, I do have another job. Its perminant, but my hours got severly cut a few months ago & I had more bills to pay than income when that happened. My perminant job hours should pick up in Oct or Nov.
Tell them you have low blood sugar and you have to eat. And if you have to, get your dr. to write a note. I'm sure if you tell him or her what is happening, they would agree that you need to eat to stay alive and will help you out!
I really think you need to report them to your state's Labor Department. I don't think that the things you are describing really are unusual circumstances as described by the law. I think they are taking advantage of you. You should find something else before you make yourself sick.
Am I the only one who thinks you need to endure? If you really need the money, and don't think you can find another job, then I don't think quitting is the smart move. Tell your boss you need to eat, work it out, or eat a huge meal before you leave and when you get home. Or bring food with you that you can eat while you work.
I have worked 24 straight hours without even a bathroom break. A 12 hour day is hardly unusual for me. And it's not that I'm superwoman, or have some quality that others don't have. I do it because it must be done. Because it was my assigned task. I hold up my end of the load.
I'm not sure exactly what your job is, but it sounds like you're looking for an excuse to quit. Maybe consider how much you need the money, what you need it for, and what you would have to do if you weren't making that money. Either way, I think explaining your difficulty to your boss will help. If there really is absolutely no opportunity to eat in the eleven hours you are working, then your boss should know that. Maybe they will schedule breaks in for you. If you decide to quit, they'll know why. Maybe they'll fix the situation, maybe they won't. But you'll never know if you don't ask.
I think it just depends what you're used to... In the industry I'm in, professionals regularly work 13-14 hours with no assigned breaks. If there is a quieter period, they try to eat then (they can't leave to grab anything though - they have to bring it or have someone else go out and get something for them).
Did you find a definition of "extreme work circumstances?" I would be surprised if you're situation was covered by that. It's not like you're performing surgery where someone will die if you step away!
can you explain a bit better abotu what your job is? what you've said doesn't make sense.
I'd just start taking your breaks.
where I work we're supposed to get a break for every 3 hours of work (or if we work 8hr day get two tens and one half)
just sit down and have something to eat, if a customer comes along and it's just you just explain it to them maybe?
is it just you at the job or others? have turn about looking after everything while the other goes on your break
I'm not an expert on your state's labour laws but I doubt your job constitutes "extreme circumstances". I would definitely consult with labour relations and see what they say.
I worked for emergency social services for a while in university during a period of time where forest fires were rampaging through a town, and ended up working 24 hour shifts without a break manning phones for people trying to see if loved ones were alive, and trying to find emergency temporary housing for people, and care for pets. To me, THAT's the type of situation those loopholes are meant for.
I have dealt with this several times, the driving is actually considered a break by federal standards in many industries, can't say about yours. Just like waitresses gets a break inbetween tables. The rules are so unspecific they are judged on can the employer answer the question just right. You might give a call to the local hour and wage office, you can give them the whole situation along with the employer, industry, circumstances, etc....and they will be able to give you a specific answer as to whether it's legal. If not you may entitled to compensation for time lost and stop them from doing it to anyone else
Thanks bees, I contacted BOLI (labor board) & yea, its illegal. Not sure how to go about this thou. They won't let me leave, what am I going to do? Walk away? Not quitting, but just for the break. However, if I step forward (file a claim), it will help so my co-workers get a break too. Not sure where to go from here...

I'm beyond upset. I just worked OVER 11 hours with a 5 minute break. I had to work all the time aside from that (a small part of that time is for driving to the location, its not my work office). I looked it up & it looks like its legal in Oregon because of "extreme work circumstances" where there's not enough people to do the job if I leave. I'm not sure. I wish it was illegal so I could say "I legally need a break". I posted a vent about 2 weeks ago & it keeps happening, I don't get breaks & I think I'm going to quit because of it, even thou we REALLY need the $.
