I have a few questions regarding my daughter’s father, and his lack of child support payments. I got a call from the child support office asking if I knew where he was and where he was working. It’s something they do about every 6 months. I haven’t seen or heard from since June of 2013. I told the case worker the little that I did know, and she told me that they would be filing an action to hold him in contempt of court.
Can anyone tell me what that actually means? Does that mean there will be a warrant in his name? Jail? Does it mean that I’ll have to go to court again too?
Thanks! Oh… I live in California if that makes any difference.

Peaceoutboyscout: It depends. Every state is different and if he is in another state, they also have different protocols. Good for you that your child support entity is willing to do this on your child’s behalf! Otherwise, you would have to go to court and/or file papers in whatever state he is in to enforce the order there. You would only need to attend court if they send you a subpoena ordering you to appear.

beachbride1216: He lives in the same city as me, I know that for sure. I’m extremely glad the child support office is taking care of a lot of this for me though!! When I filed for custody, I had to do it all on my own and I was SO overwhelmed. Thanks for your input!!

Peaceoutboyscout: If the local Child Support Agency is acting on behalf of the children, you may or may not have to testify. Often they can act soley from their records. Jail is normally a ast resort. If he is working, they can file to garnishee his wages so that the child support is deducted from his paycheque.

They’ve already tried to garnish his wages but he’s been working under the table (I suspect) since we settled, and I don’t think he filed any taxes for 2013. He is in the process of trademarking a business (I found this out through public records) but i’ve read that they cannot garnish wages if he is self-employed. I honestly don’t even really care about the money anymore. I just want him to have to face the consequences of not caring for his child. I know that sounds immature, but I’ve got my own life now, a much better one than I ever had with him!
