(Closed) Breaking a contract

What do you mean you signed a contract?  What does it say?  I’ve never had to sign a contract that gives a time frame for any sort of employment, so I’m a bit confused…

So you’re not “employed”, you’re a contractor doing a job for the company? Take a good look at the contract ( you do have a copy?) and what it says about resigning/termination….

I think moving jobs within the company will not be an option. I doubt they would extend you an offer once they learn about the contract.

Hmm, I work in hospitality and it is standard for us to sign contracts.  I didn’t sign one at my current position but have in the past.  It states that if I leave at my own will, I can’t work for another hotel within a 60 mile radius for 2 years.  It’s called a non-compete.

If I were to break it, I could/would be sued.

@LibraryBlondie:  Thanks for explaining.  Honestly, I think switching in the company will likely cause problems for you.  It looks bad if you’re looking already, a few months in, with more than half your time remaining.  I hope it works out for you, whatever you decide to do!

I would talk to HR. It’s going to come out at some point anyway (like… in the first/second interview question), so you might as well see what their policies are, and if this is a feasible move. In my/my friends’ experience, if you’re a strong performer, financial institutions like to keep you happy so you’ll stay, so if you’re trying to transfer within the company, they might be okay with it, since your skills are staying within the company. At the same time, if you’re only a comparatively mediocre performer (vs being a rock star), they might not want to deal with the hassle of having to cover you, especially if you were hired with a start class, since they don’t really like to repiece out work or hire off-cycle. I would for sure come clean now though, rather than later. Especially with financial institutions, you don’t want them to worry that you’re looking elsewhere (ie. with other companies). I would play it as “I love the company and this role popped up on my radar so I figured I might as well apply. Now that I’ve landed the interview, what are my options going forward”. This way if they say you CAN’T move, you can also cancel the interview and stay in their good books.

@Linz1231:  I think this is quite common… for example my SO works in events and all contracts within that industry say you can’t work for another events company for 6 months. In reality though, unless your changing careers, this is impossible… it’s a protective clause.

I would consider breaking the contract for an opportunity, but I’m not sure how good it would have to be…
