I have been a fly on the wall of the forums for some time now but this is my first post and I could really do with your advice please…
My fiance and I are getting married this October and originally booked a venue in February 2011 which we cancelled in January 2012, as we were unhappy with the service received which led to us losing confidence and trust in said venue. We have since found an alternative venue which we couldn’t be happier with but I’d be really grateful for your thoughts on whether we have any grounds to reclaim the £900 deposit paid on the original venue.
Whilst I understand that a non-refundable deposit is exactly that, we only cancelled as the venue changed their caterer some 11 months after our booking without notification and menu prices were increased without consultation which we were unhappy about. Plus I found out yesterday that they have since re-sold the date at an equivalent value to our own booking, so given that we cancelled through no fault of our own, some 10 months prior to the planned date which they have since re-sold, could I claim our deposit is not equivalent to their losses and as such constitutes an unfair term in the contract?
I did appeal for the return of the deposit in our initial cancellation letter, given the circumstances but to no avail; The response from the manager was so defensive and rude that it was actually laughable and came across more as a personal attack on myself and my fiance which was completely unfounded and only convinced us that we had made the right decision to cancel!
Furthermore, in addition to our main security deposit, we also paid a £200 deposit to the venue for chair covers which according to the T&Cs should have been returned immediately upon cancellation, however, I only received confirmation yesterday (7 months after our cancellation and much protest from me!) that this would be returned in full.
Given the struggle that we have had with them so far, I have accepted that we will probably not get our main deposit back and as I said, we have since found a new venue which has exceeded all expectations and is significantly cheaper than the original venue but £900 is still a hell of a lot of money to lose which could otherwise go towards our wedding, so I would be grateful for any advice you may have.
Should I admit defeat and put it down to experience or pursue it further?
