On my way to work on tuesday some douch rear ended me. HARD. I was at a dead stop, he wasnt paying attention, and hit me going baout 30ish mph. This is just so frustrating.. waiting to hear back from his ins company on what they are going to do with my car- repair it or total it… if they total it.. im pretty much screwed…
His ins guy is a total dick, pretty much telling me that if i dont have full tort(which i do) that to bad your effed… im hurting so bad from the impact… and his ins is trying to tell me that i have to pay for everything out of pocket then submit everything to get reimbursed.. okay fine.. if i had the money for everything… Im just really frustraded. I wanna scream, I wanna cry… uuggghhh

First off, I’m sorry this happened to you.
Second, stop dealing with the insurance company. Go get an attorney. Serioulsy, they can be a God send during this stuff sometimes.

@graygodess20: Bummer! If you don’t want to del with the other guy’s carrier you can always notify your company, they’ll deal with your claim, adjustment and repair or settlement and subrogate against the other carrier for the bill at the end. You don’t have to do this at the mercy of a company that doesn’t have your best interest at heart! Good luck! And make sure you get to a doctor and submit the bill!

@DDG84: Already went to er. first ambulance ride ever.. lol. i had all the xrays and all. im just gonna be sore for a bit, and once the swelling goes down will have to go to the chiro.
@Nona99: I plan on submitting EVERY LITTLE PENNY!! if that guy never hit me, i wouldnt be out of anything… im now being a bitch and gonna get nasty with the ins comp.

Did you go to the hospital? I would to document any injuries or pain from the accident. My cousin was at a complete stop waiting to make a left hand turn when a high driver hit him from behind gong 50mph. He didn’t have health insurance so he decided to skip out on the hospital visit to get checked out. Unfortunately, now he has severe back pain and problems.

Did you call your company? You shouldn’t have to talk directly to his insurance. And actually for legal purposes I wouldn’t at all, in case you need to file for damages at a later date or whatever.

@graygodess20: well, good luck. As someone from the industry I can tell you that being nasty just gets you ignored, if the adjuster assigned isn’t doing what he’s supposed to, when he’s supposed to, call the company and request to speak with his supervisor. Get as much in writing or e-mail as possible and lawyer up only when you are out of options, getting a lawyer involved moves your claim to the legal department and essentially stalls out everything.

I would take it easy the next couple of days. You don’t HAVE to deal with this this second. Work on feeling better because you will feel worse tomorrow and the day after than you do now.

Im with PPs who said you need to call your insurance company. Dealing with this is THEIR job, and frankly, I suspect you are safer legally if talk to the other guys company.

@vorpalette: +1, they won’t get away with that BS if they’re dealing with your agent, and that’s what your agent is there for!
And I’m sorry, this stuff can be so frustrating! I got hit in a similar situation and had immediate and very painful back pain, luckily it went away after about 3 days and a visit to the chiropractor so take care of yourself and don’t let this stress get to you! 🙂

@graygodess20: I work for an insurance company. I would strongly suggest that you call YOUR insurance company and allow them to handle everything. Make a claim, give them all the details, give them the man’s information who hit you and let them handle it.
Also, as a PP suggested, contact a personal injury lawyer as well.
He hit YOU from behind. He is at fault.
