Haha. That does make me laugh. FFIL offered to "accidentally" run over it with the moving truck next weekend. He wasn't seriousl but everyone is pretty peeved about it. She's just so tiny!
Well its not just that she is absolutely tiny and pathetically adorable! lol Not to mention that the dog that attacked her is a worthless dog. Mr. Bobby says "he needs a little more lead in his diet."
Plus the owner needs to be taking much better care of him! Training and ect.
Is there any way you can look up his address on the white pages? And yeah, after second though try and be sweet but firm in the first letter (still saying that he should pay for the vet bills) but leave the court discussion until later.
I am so sorry about your poor dog. My only advice is to be firm with your language in the letter so this man takes you seriously. You want him to think that his only option is to pay now or pay later (via lawsuit). I hope that he will take responsibility for what his dog did. Also, has Aminal Control followed up with you at all? Sadly, that dog sounds like it may need to be removed.
Nothing from Anima; control yet. We are going to call them again tomorrow with more information to see if the dog had been reported before. Hopefully he's smart enough to pay now because a lawsuit may not end so well for his dog. It's dogs like this that give pits a bad name. He's an adult and his owner should have taught him better.
He might lose the dog already because you called Animal Control. But I think a dog like that could go off the handle again and possibly kill another pet or even a child. People need to really watch their pets to make sure they don't end up agressive like that.

I really think it's the owner's fault, not the dog's. I know you're going after the owner for the vet bills, which is totally understandable. I just hate that animal control/courts tend to put animals down so quickly. I work with a lot of "dangerous" animals, and 9.5 times out of 10 it's that they weren't trained properly. It's sad that our society is so quick to put animals to sleep when it was usually the owner/handler's fault.
@Lilyfaith: I totally agree! Pits have such a bad rap but I think 95% of the time it is because of the owner, not the dog. It reminds me of when a bear/big cat goes wandering into a new development and they shoot it because it is a danger to the people living there. Umm, it was the animal's home first and they are confused as to why all their land was TAKEN AWAY!! You are living in THEIR natural habitat and yet you kill them when they are just trying to return home. /end rant :p

Like MissAsb said, if you know his name try looking it up in the white pages online. All you need is the state and city he lives in and his name. You might be able to find something. And yes, I would send it by certified mail.
I'm so sorry that you have to deal with this. Suck that you said he was mean. I hope he takes responsibility of his dog.

I'm not a lawyer so I might be completely off base here, but it might help to point out that you have two witnesses to the attack and to explain exactly how you know that it was his dog who attacked Pennie. Since he sounds like a complete jerk (I'm really horrified that he witnessed this and did absolutely nothing to help), he may try to deny it. If he's not aware that other people saw the attack (like your friend watching from the window), he may be thinking that he can get away with it, which is just totally despicible. Good luck, and keep us posted on how Pennie's doing!
I'm glad you've reported it to animal control, a dangerous dog has no business being out on the street.
I definitely agree with the posters above, this is not that pit's fault, it is the fault of the owner who raised him to be mean and dangerous. That said, a dog that size can inflict a lot of damage, good thing someone was able to pull him off before worse happened. If it is a first offence, most animal control agencies will tell the owner to keep him leashed and muzzled, if not behind closed gates. There is a chance he will be confiscated and euthanized, especially if he's attacked another dog before.
It's terribly sad this pit has been raised in such a way, but in the end safety comes first.
Your letter sounds good and I really hope things work out in your (and Pennie's) favor. The only thing I might change -- just in case you do have to go to court -- is the line where it says she was taken to DoveLewis as soon as possible.
"She was taken to DoveLewis Emergency Animal Hospital immediately after the incident and was required to have surgery."
I think this might be better wording for you. This way if you have to go to small claims, pit bull owner can't argue that you waited to long to have her checked out and that was your fault she needed surgery. And since he's crazy enough to let his dog run around unattended, he may not know what DoveLewis is.

I know how you guys feel about the dog. That's why I wanted to keep it out of court if possible. It's not the dog's fault. It is the owner. There are lots of nice, loving Pitbulls out there. It's one's like that that give them a bad name. She was just walking and he tore afrter her unprovoked. He understands this.
babyboo - you totally just reminded me of news stories my friend in Alaska was telling me. There was a string of bear attacks on a "trail" and they were looking into why the bears were attacking. Um, hello? Just because we chop a few trees down and make a trail doesn't mean the bears are going to be like, "oh, those people walking in my home are on a man made trail, I should not eat them."
I saw the other update,I'm glad it sounds like he'll pay. He should!
