FWIW, it appears unlikely his efforts will succeed. The provincial governments have been issuing licenses to foreign same-sex couples for years. It seems unlikely that an argument made in a particular case will overturn all that.
However, I agree that I really wish people would just accept that our marriages are as good as anyone else's. And I'm feeling thankful right now that immigration concerns prevented NotFroofy and me from getting married outside the US. As a result, we had to wait until Massachusetts opened up same-sex marriage to nonresidents. But at least the legality of our wedding is unquestioned now.
While the whole thing is disturbing, Stephen Harper was quoted as not knowing what was going on specifically, and it's actually a matter of interpretation by the courts of the existing law. It is arising as a result of a specific court case and the interpretation of the existing laws as they apply to that case. In fact, the government would have to proactively step in to change the outcome. The result would be the same if the case involved people who were too closely related by their home country's standards (in some island nations, there are requirements that people be very, very far apart, ie beyond seventh cousins).
We've been debating this over on the LGBTQ boards for a few days now. I think the general consensus is that while the wedding ceremony may have been legal at the time, they aren't legally eligible for a divorce in the Canadian courts because they aren't Canadian and/or haven't lived there for one year. It's a hot mess and it will hopefully get sorted soonish.

Are there any fellow canadian bees feeing my anger tonight? Stephen Harper is trying to revoke the rights of those married in same-sex marriages of whom both were not Canadian citizens.
I have many friend sand loved ones who are devastated, including one who is trying to get citizenship for her wife.
How can a government decide whose love is just, whose is true, and whose is right?
