Filing a judgement after winning a small claims case

    Hi all:

    I won't get into details about the case (to save you guys from boredom) but I won a counterclaim in small claims court (and the person suing us lost) in late October. The woman I won against had a month to send the payment out to us, and after that point, we were told that I could file a judgement against her to get what she owes.

    This is going to sound weird, so I apologize in advance, BUT.. Does anyone have experience in winning small claims against someone or filing a judgement and if so, has the person you won against ever harassed you/contacted you after the fact? I've been putting off filing the judgement because she's a bit out there and didn't want to deal with her contacting me, but maybe I just watch too much Judge Judy (plus, I have no experience in this so I know I'm making a mountain out of a mole hill)! -__- thanks in advance!

    It sounds like you will never see your money if you don't try to enforce the judgment.  If she contacts you and you find it threatening, you can always file a report.  It's tough in small claims because the amounts seem to minimal and sometimes it's not worth the effort to go after her property to get a recovery.  I'd at least file the judgment because then she might actually pay you.  Good luck!!

    No experience in it, but if she owes you and isn't paying I would file the judgement. Other than her being a bit off, do you have reason to worry about her or what she'll do?

    She's a cuckoo bird - so I wouldn't put it past her to reach out to me and contact me (she flew out her parents from many, many states away to be by her side for a very minor small claims issue). She's not violent or anything - I just feel that she would reach out to me if her wages were garnished (which I was told happens when you file a judgement). The amount is so minimal ($350) so it's reallly not a big deal but I won't see the money unless I file it, that's for sure. Thanks for your help, bees - :) as always

    I would go ahead and file it. If she tries anything you can always get a restraining order against her. Good luck.
