I have been told that you don't need to change your name officially on anything. Everyone is going to know that your old name is your maiden name and the new name is your married name. I'm not sure if it will make a difference later when you try to sell but I don't see why it would. It won't make any difference on your tax return. I don't see any reason to change your name. I wouldn't put your husband's name on the home title if you don't put him on the loan, just in case. You don't want to be the one responsible to pay it off if for some reason he ends up with the house.
I was told by our mortgage lender that I could change the name, but it would really only be so that I could see my married name on it. Changing doesn't serve a purpose beyond that, she said.
I've been told you can go by either name, as long as you aren't trying to commit fraud. So as long as you aren't like "I have no idea who Jane Smith is, I'm Jane Jones!" you're good to go.

It seems silly that they would charge for that! I have no legal knowledge on this topic, but I don't see why it would be a problem to leave it in your maiden name.
I just had a conversation about name changing and was also told you can use both as long as you are not doing so with the intention of committing fraud.

Hey Bees!
I've endlessly googled to try to find a researched answer on this and I'm still at a loss. I have found lots of "advice" but nothing concrete.
I have changed my name pretty much everywhere, most importantly with Social Security. My mortgage company just sent me the name change paperwork and it turns out they want to charge me a $125 assumption fee just to change my last name. That's not even counting adding my husband to the mortgage!
My question - do I have to change the name of the home loan?! Can I just leave my mortgage in my maiden name even though everything else is changed? I know it doesn't matter what name is on the check that pays that bill. But can I legally do this in NJ? Will there be an reprecussions during tax filing time? Is the hassle worth the $125?!
Has anyone been through this?
