I am a little confused about the insurance company. Did you purchase wedding insurance? If so, I am sure you will be able to change your venue as long as you provide them proof the venue will not be available on your wedding date. Also, you would really have to read the contract you signed. If the deposit was with the company that runs the venue, they may have the right to book a different room to accomodate your wedding. Usually, if the room is written into the contract you signed, the vendor would need to refund your deposit because they have breeched the contract.  A lot of contracts we read when looking for a venue stated the venue had the right to change event rooms as they see fit. But in your case, I would ask for a refund because they should have known the room is going to be under contruction prior to you putting down the deposit. Good luck.

@Miss Sequoia:

@edisonsgirl:

I agree with edisonsgirl that the venue is in breach of contract. if  the official contract you signed does not read “company’s name reserves the right to cancel or make void this contract”   or  if the venue knew like edisonsgirl stated “that the room you book would be under construction”

1. Was this an official contract  ?  (If yes you have a winning bet)2.  “Estimate contracts are not actual contracts so therefore venue or companys do not have to keep their word

3. Keep the email she sent print them out  and keep for your records

Here is where the difficult part comes I have seen it on Judge Milan, Judy, Mathis , Brown etc

The venue is still attempting to accomodate you, so they have not blantantly said “No we(venue owners) cannot host your wedding or reception here.

Key word “we are attempting to accomodate you” if you leave and book with someone else than they will keep some of your deposit because you are in breach of contract  .  Here is why

1. They did not breach the contract  because they are still trying 2. You went ahead yourself booked someplace else knowing that your current venue was still attempting to work with you

What you need to do:Write a formal letter explaing that “time is of the essence that you need a sepcific day on where your reception and wedding ceremony will take place”

1. Place a deadline  give a day and time “If I do not hear from  (company’s name) on day and time than I reserve the right to cancel the present contract and receive my full deposit of (write down exact amount) “

Insurance company : read all the fine print maybe they can get the deposit back for you 2.  Post mark the letter and get a signature receipt requested proof they received the letter 3.  Give the letter 2-3 days from when you mailed it send a second notice on the top of it  write  SEcond  notice , third notice

Also follow up with an email  cc all the top head staff , president etc of the venue where your wedding will take place (makes people respond quickly)

Do your own investigation =  YOu would win if you can find this information

“Check their website (if any) to see when they went on construction and when the expected construction date is said to end “check website to see if they had future plans to renovate before you book that show dates  some website for instance say “future construction sites commonwalls and check what day that blog was written “

go to the actual site see if they have brochures

FUTURE VENUE ADVICE
If you get all your money back than book with your dream venue However
1. Write in pen  on the contract that you are reserving “Hall A” not anyother Hall
      or you will get your full(  $write down amount) back in full in ______days
2. REad the venue in full if they do say you can get your deposit back ask how much   (write the percentage down or figure amount) ON THE CONTRACT
3. HOW MANY DAYS

WHY because when you get a copy you have proof in case this venue tries to do the same
