Purchasing an estate-sale home but daughter of estate is missing!

Oh my god, what a nightmare! Is there any chance another family member may be able to get a power of attorney privilege for the missing daughter? I’m not sure I would continue – interest rates are rising, and you can’t lock in until you have a stable closing date – and that may not be possible with this person involved. If she skips out on closing and costs you an extra week or god knows how long, it could end up costing a TON of money in rate lock extensions.

I’m also not sure I would continue with this purchase.  Between the potential squatter problem and now a missing owner, I think you will spend a lot of money to get this house, and it would be awful to have someone try to later invalidate your purchase. 

Honestly, I think this process could take a long time and be very expensive.

I just wanted to agree with the PP’s. You have a tenant who is living there and refuses to leave, and now a missing estate holder. I would back out now, before you are more emotionally invested.

They would need to get POA… something similar happened to my FSIL (FI’s sister).

Her husband was MIA (they split) and couldn’t get ahold of him but she was ready to close the sale. Eventually her lawyer was able to get in touch with her husband and got him to sign the POA form saying that FSIL was his POA to close on the house. That was the method the lawyer recommended to her to get the situation resolved.

If you have all cash, you have a lot of power, even in a tough market like where you live. I’d move on and seek another house.

@serenitea:  I hope you get your house! We’re house shopping too right now… and just fell in love with one. So I get how it is when you find the “right” one. Hopefully everything will work out for you. 🙂 Keeping my fingers crossed for you!
