@mattsgirl813:  Depends on what state you live in. You should call a local employment attorney. You could find one for free to meet with you and tell you if you have a case for wrongful discharge (constructive discharge).

You should also consider contacting any labor departments in your state now, before he quits his job, to find out what the options are for unemployment in a case of constructive discharge.

did he quit already? if not can he take it to HR? also if he hasn’t quit I would record those phone coversations and note dates and times of when he says those things to him because that should def be an HR issue that should not be tolerated.

My husband threw a pen once, not at anyone, just at a wall out of frustration and got called into HR for it…..

@mattsgirl813:  I would def look into your options. Contact the Department of Labor and see what they have to say but really look into it before he just quits. My husband was laid off by an employer in April and they didn’t pay him his last paycheck (2 weeks of work) so we filed with the DOL and still have not seen that money…apparently they are still working cases from february. I wish we had just gotten a lawyer instead.

Do some google searches on small businesses and employee complaints? or small/private owned businesses without HR departments? Also do some research on unemployment benefits…
