Quick tax question!

    Ok, so I'm hoping you guys can help!  I worked part-time in 2009, in addition to my full-time gig.  There was some kind of accounting error and I don't think I'll be getting my w-2's in time to file.  Am I able to file them in 2010?  Or at some other time?  Like an amendment or something?  I don't know if this will result in some kind of penalty, which obviously I'd like to avoid!

    You can file an extension I think.

    Yeah, I've heard of that.  But I don't think I'll be getting my w-2's for quite awhile!  (I worked in a restaurant and the owner/accountant is currently in his native country of China... so the fact that he forgot to do my w-2's is something he won't know until he returns, which isn't for a looooong time)

    Do you have your last pay stub? Isn't all of the info about taxes typically on those? I assume this is for deductions, not actually paying taxes, right?

    you won't get it by april?... just file for an extension and you'll have until 10/15 to file!

    It is my understanding that you can file any time you want. If you don't owe money, then there would be no penalty. Do you owe? If you do, I think you would pay interest on that amount for filing late. My FI is an accountant and I think that's how it works. We're in Canada though... so I guess it might work differently here!

    Thanks guys, I'll just go for the extention.  I may get it by april but I can't bank on it.  Their business practices are pretty shady.  I don't know if I'd owe so I don't want to risk any interest.

    Ummmm, isn't it illegal to NOT provide a W2 by a certain time frame? I don't remember where I heard that, but I'm pretty sure he can be royally screwed if he doesn't by a certain time? Maybe ask a tax advisor?

    Gosh, I thought there was a law stating that your company HAD to mail our your W-2 by the end of January.  I'm not a professional, though, so don't quote me on that!

    Oh I'm sure it is illegal.  But what really happened was they sent me one, with all the wrong info.  I told the manager, who was fired shortly after I spoke to him (an unrelated issue) and by the time I was able to find out that this had happened, the owner was gone.  I'm sure I'll get them in time, I'm just worried!
