No. Theres no legal recourse she can take. Obviously she tested out the phone before she bought it from you and police arent going to take her seriously. Not your problem.
I could be wrong but I'm fairly certain things are sold "as is" if it's not specified otherwise. Did she turn the phone on when you were there?
Do you get the feeling she's trying to scam you? I would be tempted to ask her to prove to me it's not working but if it's legitimately not working that's a bad bluff to call. Do you have the serial number of the device you sold her so that if you ask her to bring you the not working phone you can verify it's the same device?
Regardless, I don't think the onus is on you. I believe it's her responsibility to know what she's buying before she hands over any money but I could be wrong.
Maybe stop by the police station in the morning or call to see what they say about the situation. They would be able to give you a more definitive answer as to your responsibility to this lady.
Since it worked fine when she bought it, I'd say no refund since she could've broken it.
NO!!! No matter what condition it was in when she bought it, she paid for it knowing you were not a business, and that you may or may not rip her off, (not that you did, of course, but some people online can do that), and she was able to test the phone and determine wether or not she wanted it...as-is items are always a risk, and her carelessness with the item is not your problem.
Nope. She may have already had the same phone but broken, and is trying to scam you. On a side note I recently bought a washer and dryer set off craigslist. The man said if either didn't work he would refund my money. Well turns out the washer did not work AT ALL. The man, who happened to be a PASTOR, never did return my money, or calls. I am always leery of buying from craigslist because you could always end up screwed.
From now on buy a receipt booklet from walmart it should only cost a dollar or two. and write a receipt with every buy someone makes with all of the info! It will save you from this ever happening again. But She does not have a case at all.
I decided to refund it, which im still not pleased about but she went to the police and filed out a report and is trying to send us to court, and Since I am just starting school Monday, I really dont want to deal with all of that. This lady is crazy!!
This is why I absolutely despise Craigslist. I have run into so many crazies while trying to sell my old wedding dress, and other people I know have had really bad luck with CL.
If you ever decide to sell something like that PLEASE write up a contract.
You could respond to her and let her know that you are going to contact the police to see how to handle the situation because when you gave her the phone it was in working order and she looked at it and still bought it.
That's the thing I like about craigslist, because you see exactly what you are getting before paying for it. You can back out if yo change your mind or it's not what you expected.
I've had great experiences with craigslist, and get the feeling she's just trying to scam you. I buy a lot of cloth diapers used on an online forum and while I have never had a problem, there are a lot of scams or attempted scams that go on. It really sucks that people try to pull that stuff.
I'd meet up with her at the police station (go in first so they can SEE YOU pay her back, if that's what you decide to do)... check over the phone & see the condition its in. Check the serial number inside (hopefully you have this written down somewhere) to make sure its the same phone.
Honestly, I really wouldn't refund her because scammers like this are the reason they keep scamming... they get their way!!

Absolutely not! The phone was sold as is and it wasn't busted when she bought it. If it's broken, it's her problem.
We sold a modded Wii on CL a few years ago. The buyer was fully aware of its condition and we offered to remove it for him but he said he wanted to keep it. He knew about the mod limitations but a few months later changed his mind and wanted a refund. Needless to say he got nothing from us. We weren't about to give back a full refund after he got to use the system for months. We're not that generous.
I ended up giving this lady her money back, which I completly regret! I contacted the police the morning of, and they said they were going to check the ad and everything, well in the mean time this girl was getting really annoying, so I just gave it back, and as soon as I got home and checked my email the police officer emailed me and told me that I didn't have to give her anything. So now I am out $150, and have a broken phone.
Ouch. That sucks. You're a lot nicer than I am. She wouldn't have gotten a penny from me. When someone is an asshole, it makes me want to help them even less.

I sold a blackberry curve on kijiji (craigslist) today and just recieved a email from the lady saying that the touch pad is broke and she wants a refund. It was not broke when she took the phone and she even looked through it. Should I have to give her a refund? She is saying that she is contacting the Police and everything. I am not sure if she can do anything about it since it is only $150.
