My current apartment is great and my Fiance and I were planning on staying, so no need to give 60 days notice on not renewing our lease. Well 13 days past that mark, our apartment complex notifies us that they are raising out rent $70. We can afford it, but it is not worth it for what we are getting. I tried emailing the manager to work something out and got no response. so we started looking somewhere else. We went into the office today to let them know we were not renewing and to figure out how much we would owe them for our final partial month. They informed us we had to vie 60 days notice and pay out that 60 days in rent regardless of when that was. So our lease was supposed to end May 13th, and we now have to continue to pay until June 2nd.
My question for all you bees out there is, since they waited until after that 60 day mark had passed to tell us they were raising our rent, are we still obligated to pay for the full 60 days, or just until our original lease term ends?
I looked at our lease agreement and while it does say we have to give 60 days notice, it also says they have to notify us of any rent increases 5 days BEFORE that 60 day mark and if we dont decline then our lease renews on a month to month basis.
Any help on this would be so wonderful! I am needing to come up with a lot of money quick if i cant get out of this.
