Okay, so our rent was due on the 1st. We went online and paid it. Or so we thought. We hadn’t heard anything from our landlord so there was no reason to think anything was amis. Well, today I come home from class to find an eviction notice on my floor. The delivered it after hours so I can’t talk to anybody until the morning and I have to be out the day after tomorrow. WTF? Never a “Hey, your rent is late, here are the late fees” or anything! Just, you have 3 days to move our starting today. We went through our bank records and nothing was withdrawn. Apparently the payment never actually went through and we had no idea. We have always been early or on time with our payments and have NEVER had a single problem. I am so stressed and pissed… We are going in tomorrow morning, chashiers check in hand, and asking, no, begging for them to recant the eviction. If that doesn’t happen, we are off to court. There is no reason for this.
And I am somehow supposed to write a paper and study for an exam tomorrow. How?!?!?!?

they only gave you 3 days? isn’t that kind of illegal? I am so sorry this is happening, that sucks! I really hope you can get things figured out!

If you have to plow through and get your school work done (as hard as it may be).
I would wait on the cashier’s check, but if you can find ANY proof that there was an attempt at payment that would help. Do you live in a big complex or a smaller unit? It seems really unreasonable on the landlord/manager’s part to just hit you with an eviction notice.

Dont they send you a confirmation number or receipt after you pay your rent? Because you can just print that confirmation and take it in to them to prove that they are wrong.

So sorry this has happened to you. Is there an emergency number you can call to get in contact with your landlord. To me, this would constitute an emergency. Oh, and good luck with your paper and exam 🙂

@Mrs Hedgehog: Did you sign a tenant agreement stating that there was a 30 day notice in order for you to move out? Thats pretty standard for apartment complexes. Did you keep a copy of your tenant agreement? If he’s in violation of that agreement then he HAS to give you the days stipulated in the agreement in order to move out. I would also email him and let him know that you did attempt the transaction and that it didnt go through (can the failed transaction show up in your banking records at all?)
The second thing I would do is to make sure you get a reciept from him from now on to confirm that you have made payment to him.

@Bellanouva: I haven’t been home long enough to look through our agreement but we plan on doing it as soon as we get home. But so far it looks like they are well in lone with the state of Texas’ requirements. And the failed transaction doesn’t show up. We are w/o proof of our attempt to pay unfortunately. All they can do is look at our past perfect record and see that we have never had even a slight problem before.
@noritake22: I went up there and they had just closed. The lady that was there refused to give me any such number and told me to come back at 8:30 am. Which effectively burned 24 hours in our 3 day opening. Yeah… I was pissed. And thanks for the good luck! Hopefully I will be in a good enough state of mind to not really screw it up.
@Birdie Love: I couldn’t agree more. And it is a HUGE complex. There are 10 “communities” in one complex.

The 3 day notice is likely just notice that they are about to start eviction proceedings. I dont think they can actually make you move without 30 days notice. But look at your lease for sure.

@mzlouis2b: Unfortunately, they can. Now, if I don’t leave by the end of those 3 days the legal procedings start and unless they are willing to accept our payment plus $125 of the fees, we are contacting a lawyer and seeing what we can do. 3 days isn’t nearly enough time to find a place to live or storage for our stuff while we stay in a hotel. This whole thing is just rediculous! Mr. Hedgie is at the leasing office right now. I am supposed to be writing a paper for my exam in 4 hours but I just can’t focus…
