We gave a CC to venue to hold the date. After 2 weeks they haven’t taken the deposit. They emailed a contract but we didn’t sign it or send it back. We heard their catering was terrible so we decided not to go with them. They still haven’t ran our card not have we returnd the contract. What should we do? I thought to cancel our card but will we still be liable? I sent an email saying we were no longer interested in the venue but no response.

@bonnienclyde: I am not an attorney. However, I believe that if you did not sign a contract, you should be able to contact the vendor to request that the venue NOT charge your card, and, if they do in the interim, to receive an offsetting credit. I would call immediately and attempt to speak with someone in addition to having sent your e-mail.

In some jurisdictions the verbal contract is worth the paper it’s written on but your deposit would create a presumption of it’s existance.
My suggestion is contact the venue & try to work it out amicably. Realistically, if you cancel your card you might still be liable but they won’t necessarily chase you for it (they’d have a burden of proof). Seriously though… call them!
