That depends one your venue. Typically, caterers don't let you take food for insurnace reasons, at least that's what I've been told by venues.
Most caterers don't allow you to take home leftovers as it is a health dept violation and they will be held responsible if anyone gets sick from them. You're still expected to pay for the food though since it has to be prepared anyway.
Why are you worried that 1/3 won't show up? Did you not contact the invited guests who haven't rsvp'ed to see what their intentions are? Don't go by the "magic percentage" of folks who supposedly won't attend because it's an urban myth. More often than not, unless there is an 'act of God' that prevents people from attending, nearly everyone will show up.
