What is wrong with people!!!!! (legal bee question)

    Hi ladies, this has been one of the worst days ever! Im not sure whats going on!!!! 

    I just got home from my parents house and someone side swiped me and then took off!!!!! I cant believe this happened and to top it off, the cops said there is nothing they can do! I even got the ladies license plate and they still said that they couldnt do anything. SO.... I have a question for the legal bees. Is there anything legally I can do to make sure that this lady is held responsible for what she did??? It just seems so unfair. I am filing a claim with my insurance tomorrow morning.

    I dont understand why people feel like its ok to not take responsibility for something that they did. I feel sick and I cant stop crying :(

    Is there damage to your car? If so you can file a report I'm sure.

    yes there is a huge gash down the side of my car about 3 feet long :(

    I don't see why they say that they can't do anything if you have her license plate number! That's crazy!

    Omg and the police wouldn't do anything? I would have been so mad! That does not even sound right. Could you ask to make a report about it?

    It seems weird they wouldn't help you with this. Obviously they can match damage from your vehicle her the other persons ... right?

    Yeah I know! I was like ok, I have her license plate number ill be fine. The cop was actually making excuses for her! I was like trying my hardest not to laugh in his face, he actually said "maybe she had to go pick up her kid or something" I was like...what?

    !!! He said WHAT? That's insane! I would definitely try to talk to someone else who may be a little more helpful and a little less RUDE!

    Yeah, they filed a police report but they admitted that nothing comes of that. I am gonna have to rely on the insurance company to take care of it I guess (oh boy)

    OK I refuse to believe that if you got the woman's license plate number and there is serious damage to your car that there is nothing they can do about it. That seems utterly ridiculous. Lawyer bees where are you? 

    I'm sorry about your car :( Car stuff is the worst. (((HUGS)))

    When you report it to your insurance company give them the licence plate and they will do a DMV search and report it to the DMV and to the person's insurance, (if she has insurance).  If your insurance pays for your damages, they will look to her or her insurance carrier to pay them back.  If they don't get paid back they will file an arbitration demand, potentially followed by a lawsuit.

    I would also definitely still go down to the police station and file a report for a hit and run.  Honestly it sounds like you were unfortunate to get a few cops who were PMSing today or something because yes, they most certainly had to take a report and inform the DMV.

    Maybe she could've picked her kid up without crashing into you!!!!! OMG! I can't believe you have her plates and they aren't doing anything with that?! I'm def. no legal bee, but that seems way wrong to me.

    Well, while I'm posting on the boards, I'll answer this question.  I used to work for a personal injury law firm in PA.  I don't know ANYTHING AT ALL about Texas liability law, but it sounds like it's probably similar to here.

     

    From your posts it sounds like the police filed a report, and you're making a claim to your insurance company.  While it's doubtful that the police will bother arresting her, your insurance company will get that report, and they'll probably deny your claim if they determine that this woman is liable for the damages to your car.  You can either hire an attorney who does property damage law to sort it out for yourself or contact the woman (her info should be on the police report, or, if it's the same in TX as it is in PA, you can request it from the DMV) and get her insurance info or ask that she file a claim with her insurer.

     

    If it turns out she has no insurance, your policy would have to have provisions covering you in the event that you are injured/your car is damaged by an uninsured motorist... but that's getting into more complicated stuff.

    That happened to me a few months ago, but I only got a partial plate.  They said they would keep an eye out for the car.  When I got the police report back, it said that there would be no additional investigation.  Call you insurace company and give them the lady's license plate.  Make sure they investigate it!!

    @Honeybear:  I'm an insurance attorney.  Your insurance carrier will cover your property damage if you have collision coverage on your policy.  If you intend on making a claim for bodily injury it will be covered under the uninsured motorist(UM) provision of your policy, (provided you have one).  I would call your carrier right away because there are very stringent restrictions on timing for UM claims.  Hope that helps to alliviate some of your worries.

    Same thing happened to me- the police couldn't do anything, only because they had no way of finding the person, and the gas station denied having footage of the incident and the car (probably because the gas station was selling liquor to minors, and a drunk minor hit my car on New Years- witnesses at the gas station saw he and his buddy). I was so pissed! I was just passing this place, and the car floored it, spun out violently, and slammed the side of my car and kept going. So I understand your irritation!

    I'm so sorry that happened to you! That is UNEXCUSABLE and I'd try to talk to someone else at the police dept. That doesn't sound right what that cop did. Making excuses for the criminal?!  He obviously doesn't take his job seriously. I'd talk to the chief over that one!

    I think you should be fine even though the police couldn't do anything about it.  Call your insurance company soon and give them all the details.  They will do the best that they can because they don't want to pay for a claim on your car anymore than you do!  They will try to find this person and try to get a claim filed with their insurance company.  I'm sorry this happened to you, just don't let them walk all over you.  Good luck!
