If you didn’t receive your item and you were just posting about the bad exp, how is it libel?

I don’t know much legaleze, but it sounds like they either have a lawyer for free (husband, wife, family member, etc.) or are just willing to pay attorney fees for this kind of thing. If it were me, I’d probably remove all the posts I could to cover my @$$, then report them to the BBB. Is the letter requesting that you remove the offensive material, or are you actually getting sued?

Uhm if you can still find those other posts too about what other people said about them, I would print it, just so people can see that it’s not only you. Which I guess they could just say you made up the names and made the post yourself. buit I still would just in case. By the way I am not a lawyer, just trying to help, haha.

Would you feel comfortable posting the email you received? 

Removing your post would does not undue the libel, some state reduce damages if there is retraction, thus mitigating the damages. 

From what you have told us, it does not seem that there is an action for libel or libel by implication. If the person you mentioned is not working with the person had the bad experience with then  you might a problem. 

Overall, it seems like that they are just trying to put pressure on you, without having a cause of action.

I would save copies of any confirmation letters you have recieved from them regarding what you ordered, the date you were supposed to recieve it, and anything else you have along those lines.

Also, it is not called “libel” unless the claims you have made are false.

I’m no lawyer, but I would tread really carefully on this matter! I think it’s hard to know what to believe. I personally would probably be a bit skeptical if a person who has a history (as implied by the email she sent you) of not filling her orders and actually shipping supplies, as to whether the email was legitimately sent from a lawyer. I don’t know how they could make a case in her favor with her history, because it seems like it would provide far too much opportunity for trouble on her end.

I don’t blame you at all, and I wish you the best of luck! I doubt that the partner would actually put down the funds for “legal action”, but I could be wrong.

I hope that everything gets taken care of!

Just for future reference, it might not be a bad idea to avoid writing about anything other than your own experience regarding their business.

I would definitely get in contact with the BBB! If for no other reason then to cover your booty.

That email sounds extremely sketchy. At one point this “business partner” states: “She has asked me to assure you that your cake topper is finished” then continues on to say: ” I will personally mail it to you by the end of the week or issue a refund”. What the hell? Is it finished/ Or will there be a refund? You’ve clearly asked for your money back in numerous emails to the seller (which I hope you’ve kept), and nothing has been done to rectify the problem. I’m not even sure why the seller is having this “business partner” do her dirty work… Clearly it seems there would be no case of libel if you are stating facts that are true and you actually have proof of. (Of course, I’m no attorney…)

Keep copies of everything! It sounds to me like it might be a lot of bluffing, but you never know.

Have you contacted Etsy? I know you said she closed her shop, but perhaps there’s something they can do? Also, did you pay through PayPal? You could contact them too about getting your money back.
