My husband and I are taking a slightly different approach to our last name. Instead of me just taking his surname, we are going to use his middle name ( also a family surname ). Here is where things get tricky.
We live in IL which doesn’t recognize a marriage certificate as means for a name change other than our spouses – however, we got married in Maine, which DOES allow such changes. Since the Marriage Certificates are from Maine, will IL honor these laws?
Any help is great!

No. States recognize marriages conducted in other states, but that doesn’t mean they follow that other state’s laws on other matters like a name change. If you move to ME, change your name, then move back to IL, that would work. Otherwise, you’ll have to go through whatever process IL allows for changing your names.

Normally I would agree – but according to the legistalture on the social security website, they would uphold said change if the marriage certificate came from Minnesota for instance ( regionally speaking ), because they have a written exception — as does Maine.

Social Security is federal. Federal government has rules, and state governments have rules. You need to abide by both.

Right – but it seems like its dependant upon the marrage certificate and the issuing state. This is directly from the social secuity office:
“…According to State Attorney General Opinions, Maine permits any individual who wishes to change his or her name upon marriage to do so without resort to additional legal proceedings. See Marion P~, 1978 WL 33940, at *1 (Me. A.G.); accord George N. W~, 1980 WL 119378, at *1 (Me. A.G.). This is an exception to Maine’s general statutory requirement that all name changes be approved by the probate court. Me. Rev. Stat. Ann., tit. 18-A, § 1-701; In re R~, 342 A.2d 688, 693-95 (Me. 1975).”

To me, this makes it sound like only if you’re a Maine resident you’re good. I’d listen to Daisy_Mae
– they seem to know what they’re talking about.

The text you quoted seems to refer to Maine residents. You need to look at what IL requires. Unless IL has exceptions (which I would think is unlikely because you’re changing your name in IL), you just need to follow their law.
Moreover, any (I’d assume the same rule applies everywhere) lawyer bee isn’t allowed to give legal advice to a non-client. Just call the relevant authority, they’ll know.
