So after much deliberation and a lot of phone calls, I finally have an answer as to whether or not I have to change my name in the attorney registration records if I change it legally to my DH’s last name.
In New York: Initially I was told I had to change my name – after consulting with an Ethics Hotline and doing a little digging myself, I found out that you simply must practice under whatever name you are registered under. Since we’re lawyers, check out Rule 7.5(b) of the Rules of Professional Conduct, and NYSBA Ethics Opinion 872 references the issue, too. As long as you’re not misleading clients as to your identity, you should be fine.
So, happy day, I can continue to use my maiden name professionally! Of course, you have to update your information with payroll if you change your name, but I’m sure most firms will allow you to practice under your maiden name.
