Just have to repeat what PP posters said, smoking is not a protected class, and if you’re an at-will employee, if he doesn’t fire you on the basis of smoking, he can say it’s for fraud or lying. I mean, cause you did lie.
I personally think it’s stupid… but if he hasn’t canned you by now I doubt he will. I would personally look for another job on the dl, too.
