Find out about “advanced parole” which will give you permission to leave the country, I don’t know much about it but I know it’s what you need if you want to be able to leave the country for a short period of time before you have your full status. Find out if you should get it just in case. I’m thinking if we have a honeymoon we’ll plan it in the US just to be safe.

Hi, I just caught this thread. I’m Canadian and just moved to the US, but haven’t applied for my residency yet. Based on my visa (K-1) I will apply after we’re married. What visa or criteria are you applying for residency under?

How long it takes will heavily depend on the green card category that you fall under.  Since you say your fiance and you are applying now and that you want to be done before your August wedding and honeymoon, I am assuming you are not talking about AOS after marriage with a U.S. citizen?

I’m worried about this too! It’s nice to know I’m not the only one.

I was hoping someone could help me at least get an idea of where to start. I’m on a student visa in the US, and we’re going to get married hopefully right after my K-1 Visa is done (it’s when i’m done my degree, and I’m still on path to graduate in December of 2013). I don’t know which visa to go or what, since I’m already in the US legally. Where do I go from here? Do we do the fiance visa? Do we get married and then apply for a green card?

I think we’re going to go talk with a lawyer soon, if we can find an immigration one in the town we live in. But it’s all so stressful even without starting any of it!

If you are already in the U.S. you don’t need the K1.  The K1 is only to bring your fiance/e to the U.S. You’re already here. 🙂

Just get married before your student visa expires, then file for Adjustment of Status, which is the Green Card process. One thing to check would be if your student visa will still be valid when you start AOS. I know that J1 visas become invalid once you start the AOS process, but I’m not sure if that is the case with all visas that are not dual-intend.

@AprilJo2011:  oops I meant F-1, that’s what visa I’m on right now, not K-1. Got confused with all the numbers lol.

Well that makes it a lot easier if that’s all I have to do. We were worried it was going to be a multiple visa thing, due to having to adjust my status. I’m hoping my student visa stays valid, but if it doesn’t, I’ll just wait till I graduate to readjust.
