Probably a lot, but personally, I dont think it’s sue worthy and think this country is just too sue happy.  Shit happens, of course they didn’t want it to happen, it’s not good for business.  Unless they can prove it was something Carnival did to directly cause this, like sail with a knowingly bad engine, I hope the law suit doesnt fly.

I think that if someone became seriously ill or injured and Carnival was not offering to pay for their medical bills, that would be sue-worthy.

@Dixonswife:  I think its worthy of suit. They should pay for councilling, a replacement vacation in the very leaset. A refund isn’t enough for something that horrific!

Carnival was definitely negligent and it shouldn’t be too difficult for plaintiffs to prove that they were injured on that ship of hell.

oh, and once they were finally to port, people had to get on a FIVE HOUR bus ride?  That must have been a joyous ride.  Everyone soaked to the gills in human feces.  Riding for FIVE hours on a bus.

If THAT is what caused a loss of enjoyment of life, he should count himself lucky.

I read yesterday that Carnival will be re-imbursing the cost of the cruise, all money spent on the cruise (for drinks and stuff), paying for transportation and lodging when they got out, paying for an additional cruise, and I think I’m forgetting something.  I doubt I would sue, unless I had some sort of illness due to conditions.  But, “loss of enjoyment of life”?!  Are you f’ing kidding me?!  I have like twenty instances of “loss of enjoyment of life” per week, and I ain’t getting paid!  Some people are just way too greedy.  I’ll bet there was someone on that ship who definitely suffered more than this girl.

I saw on the news that Carnival is offering each passenger $500 cash and either a refund or a vacation credit for another cruise (I cant remember exactly if it was a credit or a refund). Thats not enough compensation for what the guests experienced but at least they have offered something.

@JaneyDcat:  +1 I think I heard one of the buses broke down, too?! What a nightmare. I understand that accidents happen and whether or not Carnival purposely did anything “wrong” to cause the situation, they still need to be held accountable for what happened.  Shit happens yes, but when someone hits my car accidently that doesn’t mean just because they didn’t intend for it to happen that they shouldn’t be held responsible to cover the damages.  I think there are lots of frivolous lawsuits in the US, but this is definitely not one of them!

I think a lot of people are undermining the severity of the situation and especially the emotional damage it could cause passengers.  This wasn’t oops the enginge broke and we’re stuck idling at sea for a couple of hours.

Also people talking about the loss of enjoyment of life – look at the legal definition it’s non-economic, emotional distress damages, not just oh hey I had a shitty time on my sewer filled cruise so I’m sueing you because it wasn’t fun.

They are getting refunded their cruise, a free cruise at a future time (when they get over it), $500 dollars, and of course their flight home I thought.  Emotional damage?  Get it together, are they really that emotional unstable that a little bump int the road is that emtionally damaging… I doubt it, there’s just dollar signs in peoples eyes now.  Oh look, they kinda scrwed up, I’m gonna go milk it for all I can.

I would be happy with the compensation they are providing BUT ……  Why wasn’t there a call for another ship to come take people?    did they not have a plan B for all emergency situations??   I can see being stuck on that ship for 1 day….. But 5?
