I live in Texas and have a common law marriage which the state of Texas DOES recognize. I am getting married by church on Sept 27. My question is how would I go about a marriage license? If I try to get a normal marriage license it would pretty much state me as single which would cause issues since we file taxes as married etc…. If I file an affidavit of common law marriage would it be the same? But an affidavit would not automatically change my last name etc… Any advice feedback would greatly be appreciated!

I’m not sure the exact answer to your question, but in Texas, a regular marriage license does not automatically change your name either. You still need to change it with Social Security and with DPS.

I understand it doesnt automatically change but with a marriage certificate that all you pretty much need to change your last name for your banking insitution ss and dps….According to the information Ive found so far with an affidavite of common law marriage it seems to make things a bit more complicated you would actually need an official court order to have it changed for it to be recognized by gov. agencies and private companies etc…

Technically we’re common law married and we file taxes together and have a joint bank acct, etc. We’re going to get the standard marriage license and go through the motions that any other couple would go through. It just seems to make things more complcated to go the other route for the same ending, ya know? As far as I know, getting married won’t change anything, like taxes you’ve already filed.

I would go talk to the people at the licensing place. The people here in FL explained a few things to us. They really are helpful.
