@topher78714:  While your situation sucks, this doesn’t apply. The contract says outright, “If Photographer cannot perform this Agreement in whole or in part due to [ . . ]” and, unfortunately, being terrible with communication, paying attention to things, etc. is not on that “due to” list.

You have to be aware, this time of year is very busy for wedding photographers, with both weddings and e-sessions, and even portraits, if she does those. Doing STD’s, albums, Thank You cards, DO take time. You will have to check her policy on STD’s, albums, etc.  Some photographers say “Please alloww 2-4, 4-6 weeks…blah blah blah” for delivery


The reference from the contract above, is  not the photographer’s fault. Yesterday was the 14th.  You will need to give her time. Maybe she was on vacation.  Some people aren’t too quick on their emails either. My photographer for  my wedding lacks communication with clients BIG TIME.  I, however, respond promptly to my clients.  Not everyone works the same.  Pick up a phone and call her instead of emailing her.  




I just think you need a little patience. This IS wedding season for photographers. Especially July and August.

@topher78714:  maybe she is waiting to see if they perhaps get forwarded to you from the other address. Sometimes that happens. But yes, I would pay for reprints myself and apologize and quickly get them reordered and take the loss.  But that is a simple human mistake by putting in the wrong delivery address. That has nothing to do with the contract.  

I have a full-time job. Clients call me during the day, but I can’t answer the phone.  I call them at lunch time and have them email  me because it’s easier to respond quickly.  Phone: Ain’t no one got time for that! LOL I don’t talk and drive, when I get home, I’m busy with dinner, kids, cleaning, so I wouldn’t return calls until after 9.  Sometimes you don’t know people’s personal lives.  So just email her then and tell her it’s her fault, you aren’t paying for her  mistake of sending them to the wrong address.

@topher78714:  Yeah I have to agree with PPs. Your photographer is perhaps slower to respond because it is busy season now and your wedding is not until next year. She made a simple mistake by sending it to the wrong address and it’s totally possible that it will be forwarded to your new address or sent back to her. Nothing about this is a crisis/failure to perform situation.

@topher78714:  I would neverf expect a cleint to pay for my mistake. But it is a pretty minor mistake. I actually sent a usb drive to an old address last week. I just apologized and sent a new one. I will say that my first priority right now are the people get married next week and not next year but that doesn’t mean i neglect them. But it may take a few days to get results for you vs. the people getting married tomorrow who have 24/7 access at this point. But this error is nothing that would allow you to cancel a contract with grounds. It sounds like maybe you just don’t trust her at all and perhaps you do want to find someone else if that is the case. But you will most likely be losing your retainer fee. If a client cancelled a wedding with me over a mis-addressed piece of mail I would think they were kind of nuts. Though again, would not be expecting you to pay again. And I’d be sending you a little “making up for the error” freebie. A print credit card etc
