The issues never end with my fiance’s employer. We’ve already had the whole discussion on if he is an independent contractor or actual employee. (He gets a 1099)
Now my question is this, can they “hold” his paycheck in order to make it a week behind? They did it the when he FIRST started working for them, which I didn’t mind, but somewhere in there they paid us anyway for a week they weren’t suppose to, making us “current” basically. Even though I told them we weren’t suppose to be getting paid that week.
Well for this past Friday, I ask Fiance about his check and he said “they are holding it this week to make it so we are a week behind”
Can they do that?! I mean, in the middle of employment with no notice??
They also don’t always pay him the full amount all at once. Like the Friday before last we only got part of his pay, then instead of them writing me a check like normal, his boss just hands him $200. So now he has to find a bank to go and deposit it in.
In the mean time I’m trying to push our bills around and figure out how to get things paid on time. Not to mention I just got hired on to my company from being a temp, which means I go from getting paid every week to every other week and guess which week I miss pay!? Yeah.. this past one… where FI’s boss is holding it.
I am at my wits end, I just don’t know if I can handle this crap anymore.
Sorry this turned into a mini vent. Really I just want to know if what they are doing is legal?
ETA: Does anyone know if it would be possible to get a small business loan ($5000) so he can get into his own truck? Do you have to have good credit? Fiance doesn’t have BAD credit, he just doesn’t have much credit. Or are we SOL
