@tnbellebee:  That’s a toughie unless there is a red light camera or you have a witness.  My guess would be that your insurance company will decide it’s 50/50 if it become a he said/she said thing.  And honestly, if your car is 12 years old… it might not be worth fixing in their eyes.  I know I got hit and run in a parking lot, and cracked my bumper on a 10 year old tercel, and they said book value was only 700 bucks at the time so it would have been a write off!

I am an insurance agent and if there is no witnesses or no cameras and your word against his you might end up losing. Sometimes the insurance companies wont take care of either one and case closed.
