Found out FMLA not approved 7 weeks into maternity leave

knickergold :  Yes, but YOU get to choose if it’s less than 12 weeks.  Your employer can’t grant less than what you ask for.

hollyberry4 :  1)  I think what you have going for you is that THEY NEVER TOLD YOU that your leave was approved or not approved or for how long.  Until you/your supervisor asked THEM, more than halfway through your leave.  That’s on them, not on you.  I mean, you had major surgery and a baby.  It wasn’t like you could just delay the leave.  I’d sic a lawyer on them ASAP.  I’m not litigious at all, but what they’ve done to you is really unfair.  At the VERY least, if they would count your MANDATORY staff meetings, you would be over the limit easily.  Frankly I would never go to another staff meeting again now that I knew they didn’t count as hours worked!!!

2)  I would quit.  It is NOT worth working for someplace that appreciates you and values you so very little.  You obviously mean less than nothing to them.  We all spend so much of our time at work – you should work at a place that is supportive.  We teach people how to treat us – what your superiors are being taught by every woman who goes through this and doesn’t fight back and/or quit is that they can keep treating people unfairly with no repercussions.

knickergold :  You really think someone should return to work 3 weeks after giving birth??? Do you realize that most daycares won’t accept babies until they are 6 weeks of age or older? There are several states that have laws where puppies can’t be separated from their mother before they are 8 weeks old. Please tell me why a dog should have more protection than a human. I’m dying to know your answer.

This is awful! I’m so sorry honestly I thought you were going to day you didn’t get it at all! I know it sucks to think about leaving her sooner. If you have the money to put a deposit down at a different child care center you can probably find one in 2 weeks depending on where you live. A small in home or smaller business will more readily understand you situation and work to help you. Have you already contacted the place she was supposed to go and they can’t accommodate her sooner?

This whole thing sucks and is so so unfair. Our system is ridiculous. Ugh it’s infuriating. It will be ok! Worse case maybe your mom can come for the two weeks and I also think you will be able to grt a Dr note!

Definitely talk to your doctor. I know that my OB would have found a “medical” reason to allow me to take the leave I wanted. After all, it ought to be of no concern to the dr. how you take your leave, so they ought to be willing to help. 

And I am shocked that the union isn’t optimistic this can be changed. I know our union reps, and they would fight hard on this – as I am sure yours are, too. But this makes me wonder whether speech therapists aren’t considered “instructional” in all districts or just some. I work in the resource department at our school (Title One), and wonder what I am technically classified as now. 

Regardless, they did not officially inform you AT ALL. This leaves you in the lurch for childcare, and they should be held responsible for that. I’d fight to get them to pay for the two weeks of childcare, and then offer that if your additional two weeks of FMLA had been approved, they wouldn’t have to pay for anything except the sub that they already have.

ohitsheragain :  Agreed. You choose it. However, in this case OP can’t do that, as she doesn’t qualify for ANY fmla leave. Her job is being nice to her by allowing the 10 weeks.

laneae :  Um I never said I supported it. I just said what happened… I’m not in HR. I priced bonds lol I just heard her from downstairs screaming at HR on a daily basis til she was let go.
