Hi,
im am engaged to be married this New Year’s Eve.
My fiancé stayed friends with his first wife & has a lot of trust in her so he has never bothered to do a seperation agreement with her.
he is the one who asked for a divorce when we first got together, they had already been separated about 2 years by then.
He owns a business & has a 60,000 pension I’m beneficiary of.
He left her the house with tons of equity etc.
im curious. Without a seperation agreement can she sell the house, keep the money & after its gone come after him for half his business & pension?
is there a deadline if she hasn’t pursued his stuff she no longer can?
they have been divorced 2 years now.

I’m not a divorce lawyer, but my understanding is that the court’s distribution of assets is final when the divorce is. There might be some time to appeal, but of the divorce has been final for two years, that time has probably passed. Is there a particular reason you’re worried about this? If so, it might be worth a visit to an estate planning attorney.

Thanks!! That’s what i was thinking too.
I just don’t have the faith in her he does. lol.
& just want to know now that we are together & my money & time is going into his business am I at risk if she decides now she wants more from him.
He’s becoming quite successful & I’m afraid that night change her desire to get more.

Reading fail! I’m so sorry. I can’t imagine that she would be able to dispute it now that the divorce is final, but I don’t know that for sure. Sorry I wasn’t more helpful.

There is no seperation agreemeNt. That’s what the post is about. lol
we are in ontario Canada. & a business grows. Determining value at a specific time would be difficult I think.
