@catracha:  Either you or he can order an extra one from the county/state she was born in. I think it’s the health department/vital records that usually handles it, and they’re usually less than $20. Just go to google and type in whatever county & state she was born in, and birth certificates and it should lead you to the right place 🙂

ETA: I think the lawyer is just being lazy, we had to order an extra one for my Fiance, he didn’t have an ID so his mom ordered it with no problem.

@catracha:  I had a hard time understanding the second part of your post, and I’m not a lawyer, so I can’t say if you are obligated or not.

Does he need the actual birth certificate? Or will a copy suffice? Sending a copy would be what I would do.

@catracha:  I have a hard time believing that a judge would entertain such a silly request, but each state has different laws, so who knows.  Get a lawyer if you can.  It’s impossible to give you counsel online, in my opinion.  Lawyers need to know a LOT more details before answering questions.

If neither of you have a way of getting another official copy of the birth certificate, then I suggest that you send him a copy only, and get a lawyer to counsel you.

I don’t understand.  You are both illegal immigrants and so you are not able to request an ID because you will be deported?  I wasn’t aware that was how it worked.

You can provide your foreign visa documents.  If they have expired (and therefore you are both remaining illegally in the US), you have 2 options:

If he is applying for citizenship he can provide the first and last page of his application:  A copy of the first and last page of an application for asylum (Request for Asylum in the United States) provided the pages are accompanied by either a receipt from the Immigration and Naturalization Service (INS) showing the application has been filed or documentation verifying the application is pending in immigration court;

You just contact the hospital where your daughter was born and the Dr who provided your pre-natal care:If you have none of the above identification and are requesting a birth certificate for your child, please provide a letter from the hospital (their letterhead) where the child was born along with a letter (their letterhead) from the health care provider who provided the mother prenatal care. The letter from the health care provider shall include the dates prenatal care began and ceased, name of the mother and the name, signature and title of the person preparing the letter.

you are not obligated to give it to him, however if he is legaly listed on the birth cert as her father than he can go down to where the city records are kept and pay for  his OWN copy of her Birth Cert.

also if you do not have a legal copy of the birth cert( hospitals NO LONGER give officaial copies of birth certificates only a decorative one) you would need to get one yourself. it has to have an official seal on it and the ones the hospitals give out now do not have the seals…
