you need to get your name on the deed. as of right now, you have NO rights to the house, and you won’t get any rights when you get married, either. the only way to get rights to the house is for you to get your name on the deed. make sure the new deed is recorded, too.

jd133 :  I was under the impression that assets from before the marriage would not be split in a divorce. So you should get your name on there.

jd133 :  no,  that is incorrect. As PP said,  premarital assets are not split during a divorce. If he had bought it during the marriage, you would have more of an argument that it belongs to both of you. If you want to own the house equally, get your name on the deed.

you should talk to your mortgage company to see what they require/allow. I don’t know whether there are advantages to doing it now or after marriage. these are legal questions, and although I’m a lawyer, I don’t do family law.

It’s just a matter of adding your name to the Deed.
