Hi, we will be doing this as well in the upcoming months. We will be talking to a lawyer directly for this.

I assume another thing to consider is when he will get everything? Are there stipulations?

Disclaimer: this is generic advice. A simple will can usually be done at a lawyer’s office for around $250.  It’s worth it.  Don’t go with these online legalzoom and crap because they’re generic and leave out important things.  You would have to designate exactly who would do what because otherwise it might all go to one of your parents if the court decides that’s best.  The lawyer will go over each piece of information you want include and may suggest some things you haven’t thought of yet.

Do you guys have life insurance? The reason I ask, is because some companies offer those things for free, or at least discounted. I have a policy that gives you a free simple will, among other things

@mrstilly: I also agree that you should find an attorney to put the will together for you. Depending on the state you are in, there tends to be a lot of little legal requirements for how wills have to be set up. Going through an attorney to make sure every loophole is closed is the best way (but not always a foolproof way) to keep a will from being probated. This is bringing up flashbacks of cases from my wills class in law school… not always the best memories. 🙂

I think it is a very good idea to get an attorney for this. There are just things that you will not think about and if you get an attorney who does Probate/estates, they know what is needed in that document.

I work in Probate Court and we have a service where we keep wills for safekeeping for $5.00. A lot of people do that

@regberadaisy: No problem, sorry I didn’t see this earlier! The company is Forester’s, I work with them as well as have insurance through them, they are fabulous 🙂 I’m not sure what other companies do those things, but when you are looking into it, be sure to ask about member benefits
