It really depends on the laws of eachs state. I know some states allow the mother alone to sign over rights if the father has never financial supported the baby. Some states give all the rights to the idiot biological parents and make adoption difficult if one parents claims to want custody. Get together with a Lawyer and see.  Maybe if you spoke with the father and allowed it to be an open adoption (not sure if thats what you want) he would be more willing. Best of luck!

Your best bet is to talk to a family lawyer in your area. From my personal experience (I’m definitely not a lawyer), courts try to keep the children in the family, extended or immediate, as often as possible. So if the court has reason for the parents’ rights to be terminated, then the chance the child will go to you is relatively high. But they have to have a reason to terminate the rights of the parents.

You should probably be talking to lawyer. They would be able to give you a better idea of your chances.

It does sound like you have more of a stable home than the father and if I was a judge you’d look more favorable than him. I hope it works out for you. Your niece needs a loving stable home to grow up in.

@swtpea31:  I’m getting a bit confused. In your last reply you state you need to talk to a lawyer, which we all agree you need to do but your last sentance says you don’t know what to do. What don’t you know what to do?

You’d definitely need a lawyer for this one, especially if the father is not on board.
