There is a stay on everything until tomorrow (Friday).  But the appeals are all ready to be filed.  So probably no marriages for a while.

I love this Yahoo article about the ruling:

“In declaring Proposition 8 unconstitutional, judge Walker accepted every argument advanced by the plaintiffs and methodically rejected every claim made by the defense. Preventing gays from marrying does nothing to strengthen heterosexual unions or serve any purpose that justifies its discriminatory effect, but harms children with same-sex parents and “the state’s interest in equality,” he wrote.

Describing the defense case as “a rather limited factual presentation,” he also said its proponents offered little evidence that they were motivated by anything other than animus toward gays — beginning with their campaign to pass the ban, which included claims of wanting to protect children from learning about same-sex marriage in school.

“Proposition 8 played on the fear that exposure to homosexuality would turn children into homosexuals and that parents should dread having children who are not heterosexual,” Walker wrote. “

Makes it all the better that this ruling came from a Republican judge who was previously perceived as having a anti-gay stance. I love it.

And one of my friend’s BF’s has said that he would feel uncomfortable marrying his Girlfriend while so many of their gay friends were denied the right…well, he won’t have an excuse anymore 😉

I’ve just been reading the full text of the Prop 8 decision, and this is cracking me up:

most people are able to answer questions about their sexual orientation without formal training.

The context was that the Prop 8 folks claimed that sexual orientation was not immutable or definable, because different researchers had different definitions of it (e.g., fantasies versus historical conduct). But the language in isolation was hysterical.
