My mom & my aunt (who we are estranged from) were gifted a piece a property about 25 years ago by my great uncle. It’s a small water front property on a lake. They have split the property taxes on it each year. A year & half ago, my great uncle passed away and left everything he owned (which was a good sized estate) to my parents, myself and my brother, and completely & specifically wrote her out of the will. She was NOT happy and explored every avenue to get around the will (she got nothing).
Since then, she has been saying she does not want to pay her share of the taxes because they cannot afford it (they are actually very wealthy). My mom said fine, I’ll buy your half of the property and you can be done with it. She demanded WAY more than the property was even worth. My mom said that she wants the property value assessed as if we were selling it and she will pay her half. She said no. She claims she already knows what is worth because someone she “knows” told her.
She says that now, she is willing to have some “document” drawn up by a lawyer, saying she has “no rights” to the property as long as we pay the taxes each year. She knows that we would like to build a house with a beach and docks on this property as a vacation getaway. So I think she is hoping that we just let her name remain on the property, while we pour money into it and then once the property value goes up, she will demand her “half”.
Does anyone have any advice? We do have a very good lawyer who has dealt with some previous issues we’ve had with her who we plan to contact after Christmas.. but my mom is very upset since my aunt keeps calling her on the phone about this.
