O wow, I am so sorry. What a BLOW. Did you have the home inspected prior to purchase? I would think the inspector would have caught this issue.

That is awful, they clearly have lied like you said. I firmly believe the lawyers involved will be on your side 100%. Its a no brainer in this case. Its deception which is a criminal offense in itself. Did you have a survey carried out on the house prior to depositing any money? i would always reccommend getting a surveyor in before signing anything.

We moved into our house in January the guy that lived here before was a builder but did a rubbish job with the plumbing. We too noticed a bubbling in a wall caused by an escape of water which must have startted prior to us moving in. Some people are so devious!

Irrespective of the poor job your inspector did, the sellers KNEW of that issue with the home, as evidenced by the engineers report dated YEARS AGO, and did not disclose that information. I think you have a legal issue on your hands with some misrepresentation. I’d seek legal counsel.

@nhoh:  What kind of settlement are you looking for? The cost to mitigate the damage, or do you want out of the contract altogether on principle of their deceipt? Their lawyer is probably screaming at them for sending you that damning engineer’s report.

That sucks – your inspector totally should have seen that (even if he can’t move furniture, you said you can see it where the deck attaches to the house).

Sounds like you are on the right track with hiring a lawyer and, with the damning engineers report from the seller, I’d think you’d have little issue getting them to pay for the repairs.  Hope I’m right!

ugh.  Home ownership is such a crap shoot!  I don’t think I have been intentionally deceived,  but I am in the middle of putting in 8k in unexpected plumbing repairs on our house and it is such a nightmare.  Luckily,  I think you’ll wind up victorious in your law suit,  it is pretty cut and dry that they knew about the pre-existing issue.  How RUDE to try and get that by you!  I can’t imagine doing that to someone else,  especially a young couple buying a home.   Karma is a bitch.

Well, they have opened themselves up to one hell of a lawsuit. I would sue the shit out of them, quite frankly. They knew and they did not disclose. Case closed.
