I think it depends on what the states call it. The NC amendment that passed bans not just same sex marriage, but also civil unions.

By what the states call it, I mean how they define the civil union. It varies from state to state.

Civil unions grant only state rights. They do not give homosexual couples the federal rights that heterosexual couples enjoy. This is a good overview: http://www.now.org/issues/marriage/marriage_unions.html

“Married couples have 1,138 federal rights, protections and responsibilities…” a civil union would grant you none of those.
