italianbride0508 : I think the whole thing was about people trying to make a point, to be honest. Trans people presenting as male or female have probably been using the corresponding bathroom for years and no one has noticed. Laws can be passed saying use the bathroom that matches your genitalia but it’s so stupid because who will be enforcing it? What’s the enforcement mechanism?
It also upsets me the time and money that has been spent on this issue, legislating and litigating, and it’s being pushed as a “women’s safety” issue. There’s a backlog of untested rape kits all across the country, due to underfunding. I’d like to see money spent on defending stupid trans bathroom bills spent on testing those kits and putting people behind bars. THAT’s a women’s safety issue.

ladyjd : I understand why that seems like a fair solution. The problem is- who will be the arbiter of to decide if a stranger “presents” as a man or a woman?
This story has been making the rounds about an idiot who barged into the women’s restroom to follow and harass a woman he thought was a man (because she was wearing baggy clothes and has short hair.)

It’s frustrating that we are now wasting energy looking for a “solution” to a “problem” that didn’t exist until some radical Christian extremists decided to make it an issue to further their political agenda.

italianbride0508 : sometimes the federal government has to do their job and “overreach” on civil rights issues…if not for this overreach & intrusion on state’s rights, I guarantee there would still be municipalities in the US where black people have to sit in the back of the bus.

italianbride0508 : So why is it okay for this to be a states rights issue but other things should be federal? How come the Trump administration is now deciding to go after marijuana even where it’s been declared legal? Why does that need any federal overreach but civil rights does not? Where’s the line?
You also never answered my question several pages ago about how you’d personally vote on these issues. You keep saying it should be decided at a local level but it seems that’s just a way to pass the buck and not state your true feelings on the issue. If YOU were voting for your local school board, would you be for or against trans bathroom rights?

llevinso : I didnt reply to you personally, but I’ve stated MULTIPLE times my opinion on the matter. You can read my posts and follow my logic. I think it’s a state’s issue, and local school discticts can decide. Schools that have trans students can work to develop a plan that works for everyone. This isn’t a civil rights issue, thus, doesn’t need to be dealt with at the federal issue. It’s an overreach of the fed (both obama and trump) to get involved.
I’ve also said that people should use their common sense to pick a bathroom. If they’re unclear on where to go, use the family restroom.

italianbride0508 : You haven’t stated where the line is drawn though between what should be up to the states and what should fall under the federal government. You just say you think this specific issue should be left up to each state. So I’m curious as to what you think is/should be the distinction.
We completely disagree on whether or not this is a civil rights issue but that wasn’t even my question. Marijuana surely cannot be thought of as a civil rights issue and yet Trump is trying to take control away from the states there. So again I wonder: where is the line?
Also, if you say people can use their common sense, does that mean you would vote in favor of letting trans people choose their own bathroom? It’s a simply yes or no question and I feel like you’ve been dancing around it throughout this entire post.

ladyjd : Yep- page 1. I said gov’t intervention was unnecessary, use the bathroom that makes sense, and when in doubt- use a gender neutral one.
I feel like this is becoming a huge issue (on both sides of the aisle). Like pp- I don’t understand how one family bathroom solves the issue. If you need more space/its unclear to you which bathroom to use…just use the big, neutral one.
Although- I don’t agree that it’s a federal gov’t issue, in which there should be any force or requirement mandating how many bathrooms/types of bathrooms offered. I think we’ve somehow navigated this issue for years without any government intervention and continue to do so.
Use the gender neutral bathroom (if available) and if not, pick which one you’re most comfortable with/ makes the most sense. Most people don’t spend THAT much time in public restrooms anyways. The goal is get in, do your business, wash your hands, and get out.

italianbride0508 : I’m failing to see a yes or no in your answer…again… You’re either being unconsciously obtuse or you’re skirting the question.
Also, any comment at all about federal v. state? It is something I’m genuinely curious about. If you’re not going to clarify your position that’s fine. You don’t owe me anything, but at least say “no I don’t want to answer you” and then I can direct my focus elsewhere.
