Hopefully someone will be able to work magic and retreive the images that are thought to be lost.

However, assuming the worst – that the pictures are gone – at this point, given no time machine to go back and re-do the moment, what you feel would be the best possible resolution for you?

@jeni.deidre:  So,is creating new memories trying to re-create the wedding including venue, decor, catering, clothing and flying in family?  Or is creating new memories more of an entirely different event, family reunion style, that would also involve travel expense and catering.

I’m not trying to be difficult, but I think until you have a good idea in mind of what it is that will try to compensate for the loss (understanding that it really cannot be compensated in the way you’d like), it’s hard to know what you should be asking from either the photographer or her insurance co.

I’m sorry this happened to you. One things to consider if you decide to sue is that if your photog is not insured you may likely never see any of this money even if you do win. It’s one thing to win a judgement, it’s another to collect it. I do wish you good luck!

@jeni.deidre:  I have been following this thread and have not commented till now.. You don’t need to defend yourself to anyone, especially to these rude people.. I recently got married and I would have been devastated, angry, and upset if my pictures were gone Because of the photographers own error.. I too put detailed decor, etc into our wedding.. I wanted detailed shot pics of things.. Just because you and your husband chose to get married at a court, for whatever reasons, that is your business and no one else’s.. It doesn’t make you any less deserving of having that dream wedding you always wanted.. I don’t see why people judge you for having the wedding.. Why do they care, they don’t know you, it’s not affecting them.. Do what you got to do.. If that means taking legal action, then so be it.. You can’t get that day back and yes pictures are our memories.. We may forget things as we get older but a picture will always show a memory, a time in our life..Good luck and I hope everything works out for you 🙂

OP, first off, I am so sorry this happened to you. I cant even imagine how devastated I would be in your shoes.

I’m just curious though… Throughout the thread it seems like folks are saying that the contract prevented you from recovering damages from the photographer for things “outside of her control” but reading what you wrote on the first page, it looks like it says “in or outside of photographers control.” I’m wondering if I’m reading that wrong? But it sounds like it is saying that she isn’t liable for things that are in her control as well as those outside her control.

@jeni.deidre:  I am so happy to hear this! I hope you are able to work with the photographer to come up with a solution that comes as close to making things right as possible. Keep us updated on how things work out with insurance! fingers crossed for you (AND your photographer) that they’ll cover the refund and other expenses. I am sure many bees are thankful that you have shared your story so they can inquire about things like backup procedures and insurance before they book a photographer. If I can help in any way just let me know!
