that’s garbage. if she didn’t specifically ask for you to include that and it wasn’t agreed on then  you’ll definitely win. i’m not a lawyer yet but i’ll be attending law school next fall and i’m a criminology major so i think i’m entitled to say that’s garbage lol. good luck with everything though!

I’m not a lawyer, so take this with a grain of salt, but if you have an email from her saying she’s ok with the pics going to the mag, and certainly if she was given proper credit (which I would think any legitimate magazine would give) she really doesn’t have much of a case. Do you have any proof she was at the launch party? If so – even less of one.

Granted I only have your post to go on, but it sounds rather petty and baseless.

It could go either way in court. A judge may want to see a signed agreement between you two, not just an email.

That is bull though. 🙁

Keep that e-mail! That may be the saver in this. Although, the photographer is probably just being a b*tch and making empty threats.

I just don’t understand the basis for the lawsuit. Who is the friend that wasn’t listed? Another vendor?

I am almost certain that the only person that would need be listed as a vendor is the photographer since you are using her photos, everyone else is listed as a nice gesture.

I hope you saved the email from her! I’m also not a lawyer, but did you have the digital rights to the photos per your contract? If so, it’s my understanding that you can do whatever you want with them!

@mobjune25: Seriously…she’s the one shooting herself in the foot on this one! Just make sure you have your own lawyer look over what you’re signing. Have her sign something saying that she will drop the suit and not sue you again.

SO had his pics used in a magazine without permission and credit, and it was really hurtful for him.  He’d spent a lot of time on those pictures.

There should have been a release for use of the pictures, not just an email; that said a verbal contract (email) does have some weighting in court.

Also, if this really is just about another vendor, then it doesn’t sound like she has a leg to stand on.
