MxChinca:  Did you get anything in writing from the company after you cancelled the order? Or, at least cancel the order in writing? 

Either of those will help settle things with the collection company. After you resolve this, you will also need to check and possibly correct your credit record.

MxChinca:  It may feel wrong that you are the one who is left with straightening out the matter, but it is your credit rating that is at risk.

If you email the website manager, can he help? You communicated with him in the past. Obviously someone at the company did not process the cancellation.

Lesson learned for the future.

Always get something in writing.

Something sounds hinky here. Was it supposed to have shipped to you, like you got a tracking number or something? I’ve never been able to cancel an order after it has shipped. Why would a collection’s agency be calling you if the order was never processed to the point of shipment? The company isn’t out anything and now neither are you. If the order never shipped (and they’d have proof of this), then how is an agency rightfully calling you?

so does the collection agency have a tracking number and your signature from UPS showing that you did indeed receive the item? If not, they’re SOL.

So what does this agency want? They are calling you about the hard drive? 

Show them the PayPal refund and explain it came back from the company for not providing the item. Speak to the collection agents manager.  Something isn’t right at all here.

Talk to the better business bureau. I had a collection agency come after me for money that I did not owe to an apartment complex I was forced to cancel the lease (long story). I ended up reporting the complex and collection agency to the BBB. In the end I did not had to pay the made up fee. Good luck!

I’m assuming the collections agency is working on behalf of the company you had placed the order with and then cancelled.

I would first try to explain it to the collections agency, and without showing them any personal information prove to them that the order was cancelled and charged back through Paypal.

If that doesn’t work–and it might not because collections agencies can be dumb about this type of stuff–then it gets a little more complicated. You should send the collections agency a cease and desist letter so that they leave you alone and then dispute the information on your credit report through the credit reporting companies.

First check your credit report to see if this information is even on there. It may not be if this agency is simply contracted to bully you about an old business dispute.

You have a right to file a dispute with the collection agency.  This will stop them from calling you and reporting anything to a credit agency.  They have to prove that you owe the money.  You need to file the dispute in writing.  I would send it certified.

MxChinca:  Did the refund come from the actual company or was it a dispute refund from paypal? I think that if it is a refund from paypal rather than the company then that is your problem right there. The company would be under the impression that the dispute was not settled and therefore sent it on to a collections agent.

I would get any information sent to you by the company that admits the shipment is unaccounted for together. I would also get any information from UPS regarding the shipping information not being in their system and then pass both pieces of information onto the collections agent. I would also ask the collections agency for a signed delivery slip like a pp mentioned.

j_jaye:  Even if she opened a Paypal dispute, Paypal’s investigation resulted in their finding that the money should be refunded and that’s that. The merchant has no right to harangue her about it and has no right to contract another agency to harangue her about it. It would be like getting a chargeback on a credit card after disputing a charge through the credit card company and then getting harangued by the merchant you got the chargeback from. It’s completely unkosher and probably illegal.

I just wanted to add that there’s no chance this shady company you placed the order with has your SSN so you might just want to double-check your credit report, write the agency a cease and desist notice, and move on.

Without your SSN they shouldn’t be able to report it on your credit.

Are you even sure it’s a legitimate collection agency? This whole thing sounds shady as hell.
