HE hit YOU. I don’t know how it is where you live, but in California (Where I spent most my life), whoever does the striking is at fault, even if the other person caused the accident.

His insurance should pay for all expenses for you and recoup your losses– you did get insurance information, right?

You are lucky in that he admitted what he did. If there were no witnesses, he could have claimed that you rear-ended him and you’d have a hard time proving otherwise.

It sucks , but at least he owned up to his stupid and highly illegal move.

Wow, that was a totally idiotic thing for the truck driver to do. Glad you’re OK!!! 

At least he admitted it was his fault. If it was his word vs. yours it could have been so much worse.

ok I have watch enough Judge judy….LOL to know if its on the police report that its his fault His insurance should pay for you car . I believe only the blue book value I believe.

I am SOOOOOO SOrry that happened to you! Car accidents just plain SUCK! I am so happy you are ok but you are right it’s all the other BS that goes with that is a nightmare. We got hit 2 years ago while we were dead stopped by a drunk driver on drugs too going 45 mph. He totalled my brand new car (I hadn’t even made the 6th payment yet) and he had the nerve to tell ME to calm down when I was bawling to my mom on the phone. My poor Fiance has had horrible back problems since then and wasn’t able to test for the fire department because now he says he can’t pass the physical test (he passed written all the times he took it). It has completely turned our lived upside down and Fiance had to find another career path which is ok, but no one he dreamed about since he was younger. He is constantly in back pain, which sucks I can’t help him. Numerous back procedures of steroid shots. No relief. he’s only 27. The jerk who hit us has NO clue what he did to our lives and doesn’t care either. It sucks. I am so sorry.

Holy Shit!  The guy is an idiot!  I would definitely sue for what you deserve!  Why should you be out money because of his carelessness?  It should be a simple, cut and dry lawsuit.

The jerk who hit us had CRAP for ins. State minimum from Florida. 10k. So I got a settlement last April (put most of it toward wedding that’s how we paid for it) and Fiance JUST got his check Jan 2nd but the ONLY reason it was any good was because he and I BOTH had awesome ins. MINE and hi (at the time we had separate policies, now they are joined) underinsured motorist paid out for us. Even our atty said she was surprised that such a young couple (I was 26 at the time he was 25) had good coverage because most people don’t realize the importance of needing good underinsured motorist ins. My mom working in ins business my whole life paid off:) I hope you are able to get a new car and get your finances worked out without beng in debt.

Please don’t get your hopes up with thoughts of lawsuits or forcing the insurance to pay for extra losses. Insurance and legal claims are limited to the actual value of the damaged property; if you have a medical bill for a hospital visit, you can get a small settlement for pain and suffering, depending on the injury, but you’ll never recoup lost pay if you missed work, or the down-payment on a new car. It’s a sucky situation, and I have no advice for you; just save yourself the heartache by approaching it realistically.

OP you may want to consider asking the forum moderators to remove your pictures, because I can see your license plate clearly, and that personal information can be dangerous to have on the Internet.

So sorry for you! It completely baffles me that he couldn’t see you. This is proof that it doesn’t matter how careful a driver you are when there are idiots on the road. And it’s always the careful driver who seems to suffer the most damage. I hope everything works out for you!
