There’s your problem.  Since the money is half his (a check made out to both of you), the bank won’t take your word that he really signed it all over to your personal account.  I’ve had the same problem with a rental deposit check in the past.

@peachacid:  that’s a 3rd party check. MOST places (banks AND credit unions) will not take a 3rd party check. there is NO way to verify the signature on the back and it puts a HUGE liability on them. I could steal your wallet, find the check in there, sign your name, and then sign my name & deposit it into my account if banks took 3rd party checks. People get annoyed with these rules and seem to just not think about or realize why they’re there.

I work at a CU and I’ve worked for a big bank before and believe me, all these policies are there for a reason. I second PPs saying if you’re nice & not demanding and willing to work with the banks/CUs, they’re more than likely going to be willing to work with you (except my one coworker who drives me CRAZY by never offering an alternative or trying to help the members out at all, he just says “we can’t take it” and gives it back to them. RUDE.) Yes, if a check is made out to you AND someone else, both parties have to be on the account in order to have equal access to the funds. If it’s made out “OR” either party can negotiate it. Most places WILL make an exception once or twice for you with things like government checks or in this case insurance checks but you have to help them help you. Bring in your man with his ID so they can know he IS okay with not having access to the funds that are supposed to be his.

Sorry for the length. Like I said, I work in banking and people get mad over things that are really there to protect them or sometimes to protect the bank. For example, stop yelling at me and being rude to me for asking you to provide a DL when you’re taking out thousands of dollars!!!! grr. /end rant

@hiroshymatetrastar:  they probably did it with your ex BECAUSE he had an account there and they could verify his signature against the signature card they had on file for him. it probably wouldn’t have been as much of a hassle if your Fiance had an account as well, consider getting him one! =)
