Hey guys, I found a thread but it was people asking about changing their names. Has anyone tried since then? Successfully?
You are required to request a name change with the Texas Department of Public Safety (DPS) within 30 days of the change. Name changes cannot be processed online. In order to change your name, you must:
- Apply at any Texas driver license office,
- Pay the $11 fee, and
- Present proof of name change. This can be a marriage license or divorce decree, certified court order, or amended birth certificate.
- Name changes for reasons other than marriage, divorce, or death of a spouse require a certified court order or amended birth certificate.
- Foreign marriage licenses or divorce decrees will only be accepted if written in English or accompanied by a certified English translation.
- Same sex marriage licenses will not be accepted for name changes.
This is what the website said, but when I called to ask if the marriager CERTIFICATE would work, she said yes. I am worried she is mininformed…

YOu posted this in the gay forums, so if that is the case, then same sex marriage licenses are not accepted (#3)

I think you may have to change your name through the courts, unfortunately, since I think Texas is still too backwards to figure out the whole gays-are-people-too thing. I dated one guy who had been previously married, and he had chosen to take his wife’s surname instead of her taking his. The DPS wouldn’t accept his marriage certificate as a valid reason for him to change his name because, apparently, the law only applies to women who take their husband’s name. I know the situation isn’t exactly the same, but it does show how strict the laws are.
Good luck to you! I hope it doesn’t become too much of a hassle!

I believe that when I was changing my name, I read that you couldn’t go the same route for a same sex marriage. Not sure where I read it or what the steps were but I think you were told wrong and need to keep looking for correct info.

I’m in the state of TN and they will not let me change my name on my DL. My I got my name changed when we got married in Iowa (one year ago on SUNDAY!) but my DL still has my maiden name. It got reall ugly at the DMV when the a$$hole told me I wasn’t really married and it didn’t count nor did he care the SSA changed my name. The courts will not “change my name” because its already changed.

You just need to go back with your social security card and get a different person. AZ has the same “constitutional” law, and the person I was with reviewed my marriage license and receipt from the SS office (it takes 2 weeks to get the new card), and changed it without a fuss. It’s just an excuse for bigots to be public about it. Keep going to different locations/people until someone will change it.
The complete process applies from this post. Really, if your name is changed with the social security office, you just have to find someone at the DMV who’s not an A-hole.
