…what should I do? Bear with me, this is going to be a long one…
Here’s the backstory: Darling Husband and I had a limited budget and no money to hire a professional photographer so we hired two non-pro photographers that had experience shooting weddings. I know both girls personally so I thought everything would be fine. Great, right? No. 1 photographer sent me an 8×10, cds with edited and unedited photos of the wedding/reception and rehearsal dinner and photos taken later that afternoon after the wedding.
The 2nd photographer (that I’m having issues with) was the 2nd photographer and was supposed to photograph the guys and me walking down the aisle and a TTD shoot a couple of days after the wedding. She was great about posting sneak peeks and the pictures are great. But, she keeps giving me excuses about sending me the promised CD of edited pictures.
It’s 6 months out and all I have is a link to the (unedited) pictures that I cannot download. She also promised a 24 hour turn around time to edit any pictures that I would like and has failed to do so on many occassions. I’m nearing my wit’s end with her. Everytime I talk to her there is a family emergency or something going on in her life. She is now basically refusing to download the pictures onto a CD and send me the pictures she previously edited and uploaded on Facebook on her photography page. Her excuse is that she doesn’t have Facebook anymore, but shouldn’t she still have the pictures saved if she was planning to send them to me?
She is now saying she doesn’t have to provide the CD since she sent me the link to the website and it’s the same thing, but I can’t download the pictures. I’ve also offered to have someone go to her to pick up the CD if she doesn’t want to pay for shipping.
We didn’t sign a contract. I didn’t think I needed one, but I do have emails with what was expected from her and what she agreed to. Is that enough to prove that she hasn’t fulfilled her obligations? Darling Husband and I also overpaid for a tip/extra editing. She never specified any specific number of images. Is there any legal action we can take to get the photos since we’ve already paid for her time/the pictures? Darling Husband is emailing the local newspaper to see if they can run a story.
Any advice? Has anyone else experienced this? Bless you if you’ve read this whole thing.
